For over fifty years the Firm has represented a large number of major and independent oil, gas, and coal companies operating throughout the Williston Basin. The Firm’s lawyers have more combined years of experience in natural resources law than any other law firm in the state, and have a proud tradition and commitment in providing to their clients legal representation for all of their potential business interests and activities in North Dakota and surrounding states.

The Firm’s natural resources lawyers have represented clients in all aspects of natural resources law including, mining, exploration, production, taxation, financing transactions, power plant construction projects, major oil and gas pipeline projects, purchase and sale of major oil fields, administrative hearings, and several areas of civil litigation in state and federal courts including "take or pay" lawsuits, oil and gas royalty lawsuits, and various landowner and mineral owner disputes. The Firm regularly provides representation for its clients in hearings before the North Dakota Industrial Commission, Oil and Gas Division, the Public Service Commission, the Tax Department, and other regulatory boards and agencies including the Montana Board of Oil and Gas Conservation. The Firm’s title attorneys have extensive experience in the preparation of drilling title opinions, mining opinions, division order title opinions, and acquisition title opinions in the Williston Basin.

The Firm’s natural resources lawyers have also been involved in numerous industry related associations including the Rocky Mountain Mineral Law Foundation (RMMLF), Rocky Mountain Oil and Gas Association (RMOGA), the North Dakota Petroleum Council, Landman’s Association of North Dakota (LAND), American Association of Petroleum Landmen (AAPL), and the North Dakota Lignite Energy Council. The Firm’s lawyers have served as past presidents of the RMMLF and RMOGA, and have served in these and other associations in several other capacities such as seminar presenters, trustees, officers and directors.

The Firm’s environmental lawyers have represented nationally based clients on clean air and water issues for many years. The primary focus of their practice deals with enforcement and permitting issues before the North Dakota Department of Health. Several of the Firm’s attorneys have been asked to serve as speakers at environmental law seminars.

Water law is another area of expertise of the firm’s natural resources lawyers. A frequent area of litigation concerns drainage of surface waters either between neighboring landowners or from industrial and mining sites. Wetlands impacts and mitigation due to development projects is another aspect which our attorneys are often called upon for their advice and counsel.
